Terms of service
Last updated October 18, 2026
These Terms of Service (the “Terms”) govern your access to and use of the websites, applications, and services provided by Harkai (“Harkai”, “we”, “us”, or “our”) (together, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of your account information, for maintaining the security of your sign-in credentials, and for all activity that occurs under your account. Notify us promptly at hello@useharkai.com of any unauthorized use.
2. The Services
Harkai connects to the tools and repositories you authorize, maintains a description of your product, and generates analyses, launch plans, and draft go-to-market materials. Some features are offered as beta or preview features. We may add, change, or remove features at any time, and beta features are provided without any commitment that they will become generally available.
3. Your content
“Customer Content” means the data, code, and materials you or your integrations make available to the Services, and the outputs the Services generate for you. As between you and Harkai, you retain all rights in your Customer Content. You grant Harkai a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Content solely to provide, secure, and improve the Services and as described in our Privacy Policy. We do not use Customer Content to train artificial intelligence models.
You represent that you have all rights necessary to provide Customer Content to the Services, including any permission required to grant us access to repositories and other connected accounts.
4. AI-generated output
The Services use artificial intelligence to generate content. Output may be inaccurate, incomplete, or similar to content generated for others. You are responsible for reviewing output, and any updates proposed to your repositories or product knowledge, before you approve, publish, or rely on them. The Services do not publish to your channels without your action.
5. Acceptable use
You agree not to, and not to allow others to:
- use the Services in violation of any law or the rights of others;
- upload or generate content that is unlawful, infringing, deceptive, or harmful;
- probe, scan, or test the vulnerability of the Services, or bypass any security or access controls, except as permitted under our vulnerability disclosure process;
- interfere with or disrupt the Services, or impose an unreasonable load on our infrastructure;
- reverse engineer, decompile, or attempt to derive the source code of the Services, except to the extent permitted by law;
- resell, sublicense, or provide the Services to third parties without our written consent; or
- use the Services to build a competing product or to train a machine learning model.
6. Third-party services
The Services interoperate with third-party services, such as GitHub, Slack, Google, Linear, and Notion. Your use of those services is governed by their own terms and policies. Harkai is not responsible for third-party services, and their availability may affect the functionality of the Services.
7. Fees
The Services are currently offered free of charge during the beta period. We may introduce paid plans in the future. We will give you reasonable notice before any fees apply to your account, and you will not be charged without your agreement.
8. Intellectual property
The Services, including all software, designs, and content provided by Harkai (excluding Customer Content), are owned by Harkai or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes. All rights not expressly granted are reserved.
If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.
9. Confidentiality
Each party may receive non-public information from the other. The receiving party will use that information only to perform under these Terms and will protect it with at least reasonable care. These obligations do not apply to information that is public, already known to the receiving party, independently developed, or lawfully received from a third party, or that must be disclosed by law.
10. Suspension and termination
You may stop using the Services at any time and may request that we delete your account by contacting us. We may suspend or terminate your access if you breach these Terms, if your use creates a security or legal risk, or if we discontinue the Services, and we will give notice where reasonably possible. Sections that by their nature should survive termination will survive, including those on Customer Content, disclaimers, limitation of liability, and indemnification.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARKAI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES OR OUTPUT WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARKAI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES. HARKAI’S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND ONE HUNDRED U.S. DOLLARS (US$100).
13. Indemnification
You will defend and indemnify Harkai and its affiliates, officers, and employees against any third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from your Customer Content, your use of the Services in violation of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Harkai is organized, without regard to its conflict of laws rules. The parties will first attempt to resolve any dispute informally by contacting each other. Any dispute that cannot be resolved informally will be brought exclusively in the courts of that jurisdiction, and each party consents to their jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and notify you by email or through the Services before the changes take effect. Your continued use of the Services after changes take effect means you accept the updated Terms.
16. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Harkai regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
